RESPONSIBLITIES OF THE AGENT

1. Comply fully with the Agent Operating Instructions provided by USSDPOS and ensure that its employees fully comply with the instructions provided by USSDPOS. 2. The Agent shall request for a recognized valid means of Identification and Bank Verification Number from its Customer and make a copy of the ID and BVN for any card transaction above N50, 000 (Fifty Thousand Naira). 3. The Agent must confirm and ascertain that the name on the Valid Means of Identification and the BVN are the same name with the name on the Card presented by the Customer for such transaction. 4. Comply fully with the provisions of this Terms and Conditions relating to all security measures applicable to card transactions. 5. The Agent shall not use its Account for any unlawful transaction prohibited by law applicable within the Federal Republic of Nigeria. 6. The Agent shall keep copies of transactions receipt print out for a minimum period of Six (6) Months and make scanned copies available to USSDPOS within twenty-four hours (24 hours) of request. This shall be the only acceptable evidence for accepting or declining a POS dispute claim. Failure to present the copy of receipt printout within twenty-four hours (24 hours) will result to an automatic reversal of the transaction which the Agent which liability will be borne by the Agent. 7. In the event of any loss or theft of POS, Mobile Phone by the Agent or by its staff, then an immediate written report of such loss or theft must be forwarded to USSDPOS by the Agent, enabling USSDPOS to freeze or immobilize the effective use of the same. 8. The Agent will be responsible for the safekeeping and proper use of its account by its staff. Each Agent shall make use of its login credentials when effecting Transactions using the in accordance with the terms of this Agreement. The Agent’s login credentials must be kept secret. The Agent shall be responsible for all Transactions undertaken using its login credentials. 9. The Agent shall, for its own protection, keep confidential all personal identification or security numbers used in transacting on USSDPOS Platform and ensure that they are not disclosed to any Third Party including staff of the Company. 10. The Agent hereby accept liability for any loss incurred or any adverse situation arising from non-compliance with any of these Terms or any other reasonable precaution(s) that should be taken for prevention of unauthorized use of the account. 11. The Agent will not hold the Company liable, accountable or responsible in any way whatsoever arising from a transaction involving any Third Party Access Point. 12. The Agent shall avoid using generic passwords that can be easily decoded as USSDPOS would not be held liable for any likely compromise that may occur.

DISCLAIMER 1. The Company shall not be held liable for any fraudulent transaction(s) carried out on the Agent’s account by a Third Party using the Agents’ login credentials. 2. If the Company provides any information to the Agent via Email, Telephone or other Channel, details provided to the Company by the Agent, the Company shall not be held liable if the information becomes intercepted, altered or misused by an unauthorized person. 3. The Agent shall indemnify and keep USSDPOS indemnified at all times against any and all costs, expenses, actions, claims, demands and damages howsoever and when so ever arising as a result of the wrongful use of the Agent’s login credentials.
